Ex-Arizona senator sues Tucson over traffic stop, claims rights violated

TUCSON, Ariz. (KVOA) – Justine Louise Wadsack, a former Arizona State Senator, has filed a lawsuit against the City of Tucson and several police officers. The lawsuit alleges conspiracy, wrongful prosecution, and violations of her constitutional rights following a traffic stop and subsequent criminal charges.

Wadsack claims she was wrongfully stopped and charged with speeding despite having legislative immunity. She argues that the charges were politically motivated. According to the lawsuit, Wadsack was stopped for speeding on March 15, 2024, while displaying her legislative immunity placard. She was not issued a citation at the time, having been informed she had immunity.

However, a criminal speeding charge was filed against her months later. Wadsack alleges this was part of a conspiracy to harm her political career due to her legislative actions. She also claims the Tucson Police Department leaked information to the media to damage her reputation which led to her losing a primary election.

The complaint outlines several constitutional violations, citing the First and Fourteenth Amendments, including free speech infringement, malicious prosecution, and selective prosecution. Wadsack is seeking a jury trial.

The lawsuit seeks general and punitive damages, attorney fees, and other relief for the alleged constitutional violations.
