Firm Files Petition to U.S. Supreme Court in Arpaio Case

Phoenix, AZ – Jack Wilenchik of the firm filed a Petition with the United States Supreme Court today on behalf of Mr. Arpaio, seeking to overturn the Ninth Circuit’s decision to replace the prosecutors in his appeal with a “special prosecutor.” The Petition can be accessed here. The Petition is an appeal from two published decisions of the Ninth Circuit (which are attached to the Petition). As Judge Callahan wrote in her dissent from those decisions (which was joined by four other judges): “the extraordinary act of appointing a special prosecutor not only violates the separation of powers, but is also sloppy, creates bad law, and invites reversal by the Supreme Court.”
